Privacy Policy

Asociación AmbiciOsas (“AmbiciOsas,” “we,” “us,” or “our”) operates the website recycleosa.com (the “Site”), through which we provide recycling pickup services and accept online donations. This Privacy Policy explains how we collect, use, store, and protect your personal information when you use the Site, request our services, or make a donation, in accordance with Costa Rica’s Law No. 8968, Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales, and its regulations (Executive Decree No. 37554-JP).

By using this Site or submitting your information to us, you consent to the practices described in this Privacy Policy.

1. Who We Are

AmbiciOsas is a Costa Rican non-profit association (asociación sin fines de lucro), Cédula Jurídica 3-002-917334, operating recycling collection services in the Uvita, Dominical, and Ojochal area and accepting charitable donations to support that work.

2. Information We Collect

We collect personal information in the following situations:

a) When you make a donation or purchase a service

Through our checkout process (powered by WooCommerce), we collect:

  • Full name
  • Email address
  • Billing address (street, city, canton/province, postal code, country)
  • Phone number (if provided)
  • Donation amount or service/product details
  • Payment information (processed directly by Tilopay — see Section 4 below; we do not store full card numbers on our servers)

b) When you sign up for recycling pickup service

  • Name, address, and contact details
  • Pickup zone, frequency, and distance information
  • Any notes you provide about your pickup

c) When you browse the Site

  • IP address, browser type, device information
  • Pages visited and time spent on the Site
  • Cookies and similar tracking technologies (see Section 7)

d) When you contact us

  • Any information you voluntarily provide via contact forms, email, or phone

3. Legal Basis and Purpose of Processing

In accordance with Ley 8968, we process your personal data only with a lawful basis, which may include:

  • Your consent, given when you submit a donation, checkout form, or contact form
  • Contractual necessity, to fulfill a recycling pickup service you’ve requested
  • Legitimate interest, to operate and improve the Site and communicate with donors and clients

We use your information to:

  • Process and confirm donations and payments
  • Schedule and manage recycling pickups
  • Issue donation receipts or acknowledgments
  • Respond to inquiries and provide customer support
  • Send updates about our programs (only where you’ve consented to receive them)
  • Comply with legal, accounting, and tax obligations
  • Maintain the security and proper functioning of the Site

We do not sell your personal information to third parties.

4. Payment Processing (Tilopay)

Donations and payments made through the Site are processed by Tilopay, a licensed payment processor operating in Costa Rica and Central America. When you enter payment information at checkout:

  • Your card or SINPE Móvil details are transmitted directly and securely to Tilopay’s payment infrastructure.
  • AmbiciOsas does not receive or store your full card number, CVV, or banking credentials.
  • Tilopay may tokenize your payment method (with your consent) to allow future or recurring transactions, subject to Tilopay’s own privacy and security practices.
  • Tilopay’s processing of your payment data is governed by its own privacy policy, available at tilopay.com.

We encourage you to review Tilopay’s privacy policy for details on how they handle payment information.

5. How We Share Your Information

We share personal information only as necessary with:

  • Tilopay — to process donations and payments
  • WooCommerce / hosting providers — to operate the Site and store order records
  • Email and communication service providers — to send receipts, confirmations, and (where consented) updates
  • Government or tax authorities — where required by Costa Rican law
  • Service providers assisting our operations (e.g., web development, accounting) — under confidentiality obligations

We do not transfer your personal data internationally except where necessary for the services above (e.g., cloud hosting or payment processing infrastructure), and we take reasonable steps to ensure such transfers meet the safeguards required under Ley 8968.

6. Data Retention

We retain personal data only for as long as necessary to fulfill the purposes described in this policy, including:

  • Donation and transaction records, as required for accounting and tax purposes under Costa Rican law
  • Contact information, until you request deletion or withdraw consent
  • Website analytics data, in accordance with our cookie retention settings

When data is no longer needed, we delete or anonymize it.

7. Cookies and Tracking

The Site may use cookies and similar technologies to:

  • Enable checkout and cart functionality
  • Remember your preferences
  • Understand how visitors use the Site (analytics)

You can control or disable cookies through your browser settings. Disabling certain cookies may affect the functionality of the checkout or donation process.

8. Your Rights Under Ley 8968

As a data subject, you have the right to:

  • Access the personal data we hold about you
  • Rectify inaccurate or outdated data
  • Delete your data, where legally permissible
  • Object to or restrict certain processing
  • Withdraw consent at any time, without affecting the lawfulness of processing before withdrawal
  • File a complaint with PRODHAB (Agencia de Protección de Datos de los Habitantes), Costa Rica’s data protection authority, if you believe your rights have been violated

9. Data Security

We implement reasonable technical and organizational measures to protect your personal information against unauthorized access, loss, misuse, or alteration, including secure checkout (SSL/TLS encryption) and restricted access to donor and customer records. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

10. Children’s Privacy

The Site is not directed at children, and we do not knowingly collect personal information from minors. If we become aware that we have inadvertently collected such information, we will take steps to delete it.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The “Last updated” date at the top of this page indicates when it was last revised. We encourage you to review this page periodically.
